Muddy Cook is committed to protecting your privacy. Your information will only ever be used lawfully and in accordance with the Data Protection Act 1998.
We need your information in order to process your order and to provide you with the best possible service.
We use the information that you provide to us for:-
• Processing any order or enquiry by you.
• For statistical purposes to establish the popularity of ingredient/ product ranges to ensure ongoing availability of popular ingredients/ products.
• To administer our business
• To notify you of any product developments which may be interest to you, but only if you have opted to receive such updates.
Should you be aware that your personal data has become inaccurate or incomplete, you have the right to gain access to that data for the purposes of having it deleted or corrected and in any event may choose to have it deleted from our systems.
We do not share your personal information with any third party.
Security
Payments are secure and processed by Protx and NatWest Streamline. The Protx system ensures that all sensitive information is stored on a heavily encrypted database protected by multiple firewalls.
ORDERING INFORMATION
Payment
Payments are made online through a secure environment by credit card. We accept Visa, Visa Debit/Delta, MasterCard, Maestro, Solo and Visa Electron.
All prices quoted on the website are correct at the time of publication and are shown as pounds sterling and include where required VAT at 17.5%.
Online Order Confirmation
You will receive an order confirmation email as soon as you have placed an order. Please keep it in a safe place as we may ask you for information from it in any correspondence. If you do not receive this email please contact orders@muddycook.co.uk or call us on 020 8874 2729.
Availability
We aim to mix and despatch all customised mueslis within 72 hours of receipt of order. Depending on stock availability, all products from the Cook Shop will be despatched within 48 hours of receipt of order. If your order is likely to take any longer, we will contact you. In the unlikely event that any of the items you have ordered are out of stock we will contact you as soon as possible.
Pricing
We do our best to ensure that all prices on our website are up to date and current at all times. However, despite our best efforts some may be incorrect. Please be assured however that as part of our order checking and dispatch processes we do verify our prices. In the event that the price is lower than our stated price, we charge the lower amount and still send you the product. In the event that the current price is higher than our stated price, we will contact you to discuss this. We do however reserve the right to withdraw the product from sale at the incorrect price and cancel your order.
Cancellation
If you wish to cancel an order, you may do so by contacting us at orders@muddycook.co.uk or calling us on 020 8874 2729 You must do this as soon as possible and in the case of customised muesli mixes within two hours of placing the order.
Amending your Order
If you wish to make any other changes to the order, such as amending the delivery address or adding or deleting items, please email orders@muddycook.co.uk within two hours of placing the order.
CONTRACTURAL INFORMATION
Order acceptance
Due to the hand personalisation of the muesli, order acceptance between you and Muddy Cook takes place two hours from receipt by you of our order confirmation email. The only exception is if we notify you that we do not accept your order or you have cancelled it in accordance with the instructions above.
Non-acceptance of an order may be a result of one of the following:
• The product you ordered is unavailable from stock
• Our inability to obtain authorisation for your payment
• The identification of a pricing or product description error
• Your not meeting the eligibility to purchase criteria set out below
If there are any problems with your order, you will be contacted by us by email.
We reserve the right to reject any offer to purchase by you at any time. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure but, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.
Contract Cancellation
As each customised muesli is made on demand and our aim is to offer as short a turn-around of orders as possible, we regret that we can only take cancellations for muesli orders up to 2 hours from receipt of the order confirmation email. For products purchased from the Cook Shop, you may give us notice of cancellation of your order within 7 working days of the date of your order. If your order has already been despatched, then a full refund will only be given once the goods are returned.
Description of Products
Each product purchased is sold subject to its product description. We take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the information, including product descriptions, appearing on this website at a particular time may not always reflect the position at the exact moment you place an order.
Payment
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
Refusal of Transaction and Eligibility to Purchase
We reserve the right to withdraw any products from this website at any time and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.
We will not be liable to you or any third party by reason of:
• Our withdrawing any product from this website whether or not that product has been sold
• Our removing or editing any materials or content on the website
• Our refusing to process a transaction or suspending any transaction after processing has begun.
To be eligible to purchase products on this website and lawfully enter into and form contracts on this website under English law you must:
• Register by providing your real name, email address, payment details and other requested information
• Be over 18 years of age
• Stipulate a delivery address in the United Kingdom.
Please note that PO Box numbers, hotels and accommodation addresses are not acceptable
• Possess a valid credit or debit card issued by a bank acceptable to us.
By making an offer to buy a product, you specifically authorise us to transmit information or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
